Process Serving in Illinois for Out-of-State Cases
When Your Case Is Elsewhere but Your Defendant Is in Illinois
Attorneys handle matters that cross state lines all the time. A case is filed in one state, but a necessary party, a defendant, a witness, a garnishee, lives or works in Illinois. Suddenly counsel who knows their own jurisdiction well is faced with serving someone hundreds or thousands of miles away, under rules and local practices they do not deal with every day.
This is a routine part of our work at Supreme Investigations. We serve Illinois subjects on behalf of counsel across the country, so an out-of-state attorney does not have to learn Cook County on the fly or hope that a distant server gets the details right. You stay focused on the case; we handle the service on the ground here.
The Rules That Govern Service Here
Service of process in Illinois is governed by 735 ILCS 5/2-202. In general terms, service is performed either by the sheriff or by a person the court has authorized as a special process server. For an attorney licensed elsewhere, the practical point is that service must be carried out by someone who can serve properly under Illinois law and who can produce a sworn return that reflects how it was done.
Out-of-state matters add their own wrinkles. Documents issued by another state's court, interstate subpoenas, letters rogatory, and similar instruments each come with their own requirements, and the originating court's rules still govern the case. We work within whatever framework your filing requires, and because every situation is specific, we coordinate with you on anything that touches the law of your jurisdiction rather than guessing at it. This is not legal advice about your case; it is the on-the-ground execution of the service your filing calls for.
Finding the Subject Before Serving Them
Out-of-state counsel often has an address that is old, incomplete, or simply wrong. People move, and a defendant who knows a suit is coming may be harder to pin down. Before anyone attempts service, it helps to confirm the subject is actually where the file says they are.
We handle locates and skip tracing as part of the same engagement, which keeps the two steps coordinated instead of scattered across vendors who never speak to each other. Using licensed investigative databases and Illinois public records, including county property, court, and business filings, we develop and verify a current address. Then we attempt service there. When a defendant turns out to be evading, that combined locate-and-serve approach means the effort to find them and the effort to serve them are documented as one coherent record.
Affidavits and Returns That Hold Up
The single most important deliverable in an out-of-state matter is a return or affidavit of service that will withstand scrutiny in a courtroom you are not standing in. If the service is later challenged, that document is what defends it, and you need it to be precise.
Every attempt we make is logged with time stamps, and the return we prepare is accurate and court-admissible, describing how, when, and where service occurred and on whom. When service cannot be completed despite genuine, repeated effort, we document that diligence too, so you have a clear record to support a motion for alternative service or whatever next step you decide to pursue. The point is that the paperwork should never be the weak link in your case.
Working With Counsel From Another State
Distance should not mean friction. We communicate clearly about what we have, what we are attempting, and what we are finding, and we send documentation promptly so your file is never waiting on us. When a subject has multiple possible addresses, a business and a home, or a pattern of avoidance, we tell you what we see and agree on an approach rather than burning attempts blindly.
The work is performed personally by a licensed Illinois private investigator and never outsourced, so the person reporting to you is the person serving your defendant. Supreme Investigations is licensed by the Illinois Department of Financial and Professional Regulation under 225 ILCS 447, holding Agency License #117.001922 and Detective License #115.002750. We are based in Chicago and cover Cook County, DuPage County, and the wider Chicagoland area, and we are bilingual, se habla español.
Clear Pricing, Quoted Up Front
Our process serving is $225 for a standard subject and $650 for a hard-to-serve subject, which covers up to roughly six hours of attempt time including travel. When a locate is needed first, that work starts at $650. Every engagement is quoted in writing before any work begins, with no surprise mileage, toll, or report fees, which makes it easy to pass a predictable cost along to your client.
